Terms and Conditions

SweatRecruit is a two-sided recruitment marketplace connecting Employers (gyms, studios and wellness businesses) with Candidates (fitness, wellness and allied health professionals) in Australia. SweatRecruit provides a platform for Employers to advertise roles and for Candidates to apply for those roles. SweatRecruit is not a party to, and is not responsible for, any employment, contracting or other arrangement formed between an Employer and a Candidate.

• You must be at least 18 years old to create an account.
• You must provide accurate, current and complete information during registration and keep it up to date.
• Employers must be lawfully authorised to act on behalf of the business they represent and to hold a valid ABN where required.
• SweatRecruit may refuse registration, or suspend or terminate an account, at its discretion where these Terms are breached or where we reasonably believe an account poses a risk to the platform or other users.

• Employers and Candidates each register through a separate flow and are responsible for maintaining the confidentiality of their login credentials.
• You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use.
• Email verification is required to activate an account.

• Candidate registration and use of the App to browse listings, build a profile and apply for roles is free, and will remain free. SweatRecruit does not charge Candidates at any stage.
• Candidates may be prompted to complete their profile before applying to a role.
• By applying to a listing, you consent to your profile and application information (including your cover note, where provided) being shared with the relevant Employer.
• Unverified profiles are visible to the Candidate but hidden from Employer search until identity and qualification verification is complete. Candidates may still apply for roles while verification is pending, and a “pending” badge will be shown to Employers on such applications.

• Candidates seeking a “Verified” badge must upload a government-issued photo ID and copies of relevant qualification certificates.
• In Phase 1, verification is performed manually by SweatRecruit's admin team. Approval or rejection (with reason, where rejected) will be communicated to the Candidate.
• Verification confirms that the submitted documents were reviewed and appear to meet the stated criteria. It is not, and must not be relied upon as, a guarantee of a Candidate's competence, professional standing, character, or continued currency of any licence, registration or certification. Employers remain responsible for conducting any further checks (such as working-with-children checks, police checks, professional body registration checks, or reference checks) they consider necessary before engaging a Candidate.
• SweatRecruit reserves the right to revoke a Verified badge at any time if information is later found to be inaccurate, fraudulent or out of date.

• Employers must select and pay for a plan (Standard or Premium) before a job listing goes live, via Stripe.
• Standard plan: single job listing, active for 30 days from publication.
• Premium plan: unlimited job listings for 12 months, headhunting/candidate search access, and priority placement, at the pricing displayed in the App at the time of purchase.
• All prices are in Australian dollars and exclusive of GST unless stated otherwise. Tax invoices are generated automatically via Stripe upon payment.
• Listings go live immediately upon confirmed payment and, unless renewed or upgraded, expire automatically at the end of the applicable plan period.
• Except as required by Australian Consumer Law or as otherwise stated at the point of sale, fees are non-refundable once a listing has been published.
• SweatRecruit may change plan pricing prospectively at any time (including the pricing changes anticipated at the Phase 2 transition described in the Developer Brief); any such change will not affect an active, already-paid listing or subscription term.
• Employers are solely responsible for the accuracy and lawfulness of the content of their job listings, including compliance with applicable employment and anti-discrimination laws.

SweatRecruit provides a platform to facilitate connections between Employers and Candidates. We do not guarantee that any listing will receive applications, that any application will result in an interview or engagement, or that any engagement formed through the App will be suitable, lawful, or successful. Employers and Candidates are solely responsible for any arrangement they enter into with each other, including negotiating terms, verifying suitability, and complying with applicable workplace, health and safety, tax and employment laws.

You must not:

• Provide false, misleading or fraudulent information, including in relation to identity, qualifications, or business details;
• Upload another person's ID or qualification documents, or otherwise impersonate any person or entity;
• Post discriminatory, unlawful, defamatory, offensive or misleading content;
• Use the App to solicit users off-platform to circumvent applicable fees, where doing so breaches these Terms;
• Attempt to interfere with, disrupt, reverse-engineer or gain unauthorised access to the App or its systems;
• Use automated means (bots, scrapers) to access or extract data from the App without our prior written consent; or
• Use the App for any unlawful purpose.

We may remove content, suspend or terminate accounts that breach this section, at our discretion.

• The App, including its design, software, trademarks, logos and content (excluding user-submitted content), is owned by or licensed to SweatRecruit and is protected by intellectual property laws.
• By submitting content (including profile information, listings, images and documents), you grant SweatRecruit a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce and display that content solely for the purpose of operating and promoting the App.
• You must not copy, modify, distribute or create derivative works from the App or its content except as permitted by these Terms or by law.

The App integrates third-party services, including Stripe (payments), Google Maps (location/search), Google Analytics (usage analytics), and an email delivery provider (transactional notifications). Your use of these integrated features may also be subject to the relevant third party's own terms and privacy policy. SweatRecruit is not responsible for the acts or omissions of these third-party providers.

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. SweatRecruit does not warrant that the App will be uninterrupted, error-free, or secure, or that verification outcomes, listing content or user-submitted information are accurate or complete.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, SweatRecruit excludes all liability for any indirect, incidental, special or consequential loss, or loss of profits, revenue, data or business opportunity, arising out of or in connection with your use of the App, including any dealings between Employers and Candidates. Where liability cannot be excluded but may be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

You agree to indemnify and hold SweatRecruit harmless from and against any claims, losses, liabilities and expenses (including reasonable legal costs) arising out of your breach of these Terms, your misuse of the App, or your violation of any law or the rights of a third party.

• You may close your account at any time via the App or by contacting us.
• We may suspend or terminate your account, or remove content, at our discretion, including where we reasonably believe you have breached these Terms, engaged in fraudulent conduct, or where required by law.
• Fees already paid for an active listing period are non-refundable on termination for breach, except as required by law.

We may modify, suspend or discontinue any part of the App at any time. We may update these Terms from time to time; material changes will be notified within the App or by email, and continued use of the App after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia in relation to any dispute arising out of or in connection with these Terms or your use of the App.
